Sharia Law and The Death Penalty Debate: Emergence of Conflict of Laws

The death penalty in Nigeria has been a controversial issue which has ignited debates countrywide. The Federal Government of Nigeria is organizing a national debate on whether to abolish or uphold the punishment. However, some states in Nigeria apply the Sharia law under which death penalty, as a form of punishment is provided for. This paper discusses the conflict of laws that might arise in case the punishment of death penalty is abolished considering the view that Nigeria is predominantly a Muslim state where sharia law is applied in certain states and provides for death penalty of certain crimes whose punishment differs with the criminal code.
